The property is zoned R-SM (Residential, Selva Marina) and is located outside of the Old Atlantic Beach overlay. For the developer to split this into two individual lots, the following minimum requirements from Section 24.109 must be met:
- Lot Area: 9,000 sq. ft.
- Lot Width: 90 ft.
- Lot Depth: 100 ft.
Current Status: The existing lot has a depth of about 120 ft. and frontage along 19th Street of about 182 ft. Based on these dimensions, the property meets the requirements to be split into two lots, provided each new lot adheres to the standards above.
Tree Mitigation
Under current code, the developer is required to either replant or pay into the Tree Fund.
- Current Calculations: Total mitigation is currently at 636.5 inches (after applying the maximum 40-inch credit for preservation), which equates to $115,206.50.
- Arborist Letter: The developer says an arborist letter is forthcoming. Per state statute, if an arborist provides a Level 2 Basic Tree Risk Assessment identifying trees as high-risk or dead, mitigation requirements for those specific trees would be eliminated.
- What to Expect: While the developer expressed a desire to plant new trees, the high mitigation total suggests they will likely utilize a “plant and pay” strategy to meet their obligations.
